Hiring in India: Your Questions, Answered

The questions we get asked most, answered the way we would answer them on a call.

Is it legal for a UK company to hire someone in India?

Yes. What you cannot do is put someone living in India on your UK payroll, or treat a full-time worker as a contractor to avoid employing them. Our India-based partner employs your hire on a compliant local contract, which is a well-established and entirely legitimate arrangement.

How Employer of Record works

Do we need to set up a company in India?

No. That is the point of the arrangement. Setting up an Indian subsidiary to employ one or two people would cost far more than it saves.

How much does it cost?

One monthly invoice: your hire’s salary and employment costs, plus a transparent management fee. For most support roles the all-in figure is roughly a third of the equivalent UK hire once you add employer National Insurance and pension.

What about the time difference?

India is 4.5 hours ahead of the UK in summer and 5.5 in winter. A standard Indian working day already overlaps most of yours, and we recruit for whatever overlap you specify. Many candidates actively prefer UK hours to US ones.

How good is their English?

English is an official language of India and the working language of its professional sector. We screen spoken English on video before anyone reaches your shortlist, and you interview them yourself before deciding.

What happens if the hire does not work out?

Every placement carries a 6-week probation period. If it is not right within that window we restart the search at no additional fee. After probation we handle the exit properly under Indian employment law and begin a replacement search.

How is this different from a recruitment agency?

An agency finds you a person, invoices a percentage of first-year salary and leaves. You are then left needing to employ someone in a country you have no presence in. We recruit and employ, and we stay involved for as long as the person is with you.

How is this different from Deel or Remote?

Those platforms give you employment infrastructure across many countries, but you find the candidate yourself. We do the recruiting too, and we only cover one route — so we know the Indian market for your role rather than offering shallow coverage of forty.

What about GDPR and our data?

If your hire handles personal data of UK or EU individuals you remain the data controller, and you need appropriate safeguards for transferring that data to India. This is manageable and extremely common, but it is your responsibility rather than something an EOR removes. Raise it with whoever advises you on data protection before the first day.

Who provides their computer and internet?

Arrangements vary — some clients ship equipment, some fund a local purchase, some add an equipment allowance to the package. We screen for reliable home internet and a power backup arrangement, which genuinely matters in some Indian cities.

Can we meet them in person?

Nothing stops you visiting, and some clients do. Others fly their hire to the UK once a year. Neither is required, but both tend to be worth it once a person has been with you a while.
